01Acceptance of terms

These Terms of Service ("Terms") govern your use of the Trailmark mobile application and website (collectively, the "Service"), operated by Nephthali Salam trading as Atlas Kane ("we", "us", "our").

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not create an account or use the Service.

02Who can use Trailmark

You may use Trailmark if:

05Your content

Trailmark allows you to create and upload content including travel logs, notes, and photos ("User Content"). You retain full ownership of all User Content you create.

By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide licence to store, reproduce, and display your content solely for the purpose of operating and providing the Service to you. This licence exists only to provide the Service and terminates when you delete the content or your account.

You are solely responsible for your User Content. You represent and warrant that:

We do not proactively review User Content, but we reserve the right to remove content that violates these Terms if brought to our attention.

Account deletion: When you delete your account, all your User Content — including photos, visit records, and profile data — is permanently and irreversibly deleted from our systems. This action cannot be undone.

06Our intellectual property

The Trailmark app, its design, branding, name, logo, tagline ("Your world, stamped."), and all underlying technology are owned by Nephthali Salam and are protected by intellectual property laws.

We grant you a limited, personal, non-transferable, non-exclusive, revocable licence to use the Trailmark app on your personal device for the purposes described in these Terms. This licence does not include the right to:

07Third-party services

Trailmark integrates with third-party services including Google Maps, Google Places, Supabase, and others described in our Privacy Policy. Your use of these services through Trailmark is subject to their respective terms and policies.

In particular, your use of Google Maps and Google Places features within the app is subject to the Google Maps Platform Terms of Service.

We are not responsible for the content, availability, or practices of any third-party services. Links to third-party websites or services are provided for convenience; we do not endorse their content.

08Service availability

We aim to keep Trailmark available and functioning at all times, but we cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may release app updates through the App Store and Google Play. We recommend keeping the app updated to the latest version to ensure access to new features and security patches.

09Disclaimers

Trailmark is provided "as is" and "as available", without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including:

Travel data, country counts, and geographic statistics within the app are for personal journaling purposes only and should not be relied upon for travel planning, legal, or official purposes.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

10Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Nephthali Salam, Atlas Kane, or any of our affiliates be liable for any:

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) £50 GBP (fifty British pounds sterling).

These limitations apply whether the liability arises in contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

11Account termination

By you: You may delete your account at any time via the Account screen in the Trailmark app (Settings → Account → Delete Account). Upon deletion, all your data is permanently removed from our systems. This action is irreversible.

By us: We reserve the right to suspend or terminate your account, with or without notice, if:

Upon termination by us for cause, we may permanently delete your account and all associated data. Where termination is not for cause, we will provide reasonable notice and allow you to export your data before deletion.

Provisions of these Terms that by their nature should survive termination (including sections on intellectual property, disclaimers, limitation of liability, and governing law) will survive.

12Changes to these terms

We may update these Terms from time to time. When we make material changes, we will:

13Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer resident in a European Union member state, you may also be entitled to bring a claim in the courts of your country of residence.
